booL THE COURIER JOURNAL, SATURDAY, FEBRUARY 26, 1994 A 13 Court overturns verdict in threat on mayor's wife By DEBORAH YETTER Staff Writer A federal appeals court has overturned the conviction of Jerry Sue Griffith, convicted nearly two years ago of threatening the wife of Louisville Mayor Jerry Abramson. And Griffith who already has served her 21-month sentence and been released was back in court yesterday to determine whether the government has any further right to hold her. The 6th U.S. Circuit Court of Appeals overturned the conviction, ruling that Griffith should have been found not guilty by reason of insanity. The ruling requires Griffith to prove she is not a danger to anyone.

Because the prosecution and defense in the original trial agreed that Griffith was mentally ill, the judge should have instructed the jury that it had only two possible verdicts not guilty or not guilty by reason of insanity. "If the jury had found her not guilty by reason of insanity, the government still would have been able to keep Griffith in custody until a judge determined she was not a danger to anyone. Griffith, 49, was infatuated with Abramson and had harassed him with telephone calls, letters and visits to his various public appearances, according to testimony. She was arrested in November 1991 and charged with threatening the mayor's wife, Madeline, by telephone. Yesterday, Griffith's lawyer, William M.

Butler tried to show that there is no reason to detain Griffith further and that, since her release from prison last May, she hasn't threatened anyone. He and Assistant U.S. Attorney Terry Cushing agreed to submit to the court a psychiatric report that found Griffith didn't represent a danger. The report was done before she was released from the Federal Medical Center in Lexington, which houses prisoners with a medical or psychiatric condition. Griffith testified that since her release from prison, she has found an apartment, reported regularly to her federal probation officer and avoided any possible contact with the Abramsons.

After hearing several hours of testimony, U.S. District Judge Charles Simpson III adjourned the hearing until next Friday so the psychiatrist who evaluated Griffith in Lexington could be called as a witness. According to court documents, Hensley alleges that Pospisil stalked her between September and this month and "with intent to satisfy his own sexual desires threatened to touch Lorie Hensley using imminent threat of force." She also alleges that during that same period he intimidated her on different occasions by sitting in a car in front of her house.

In some of these instances he was in his police uniform, her statement to police says. She also alleges that he harassed her by telephone. Culwell said Pospisil will have a hearing by the Police Merit Board about the allegations. If the board determines he violated department policy, he could be suspended or fired, but would not lose his police pension. Anderson said he would 1 present evidence and make a disciplinary recommendation to the board after the court case is resolved.

Prosecutor Stan Faith said a Class A misdemeanor carries a maximum one-year jail term. If convicted of all three misdemeanors, Pospisil could receive up to three years, but it is likely that any sentences would run concurrently, Faith said. By VALERIE KINCAID request, removed anwering-ma- A New Albany, police officer was arrested at police headquarters yesterday and charged with stalking, harassing and intimidating a New Albany woman. "Ain't this a big surprise," said Officer Charles L. Pospisil as he was led in handcuffs into Floyd Superior Court yesterday morning for his initial hearing on the three misdemeanor charges.

His bond was set at $200,000, and an April 24 trial date was set. Judge Richard Striegel also issued a protective order barring Pospisil from contact with the woman, Lorie Hensley. Pospisil Pospisil, who has been with the department for 21 years, has been suspended with pay. Capt. Michael Culwell, a police spokesman, said Hensley complained to department administrators last June that Pospisil was harassing her.

Culwell said no criminal charges were filed then, but Pospisil was warned by department officials to stay away from Hensley. Culwell said Hensley told police a few days ago that the harassment had not only continued, but had worsened. New Albany police Chief Mathie Anderson said he then, at Hensley's CRIME REPORTS SEXUAL ASSAULTS A 28-year-old Portland woman said a man she accepted a ride from in November took her to Shawnee Park, held a knife to her throat and sodomized and raped her. She later jumped out of his van and fled. A 30-year-old Clifton woman said a man she knows pushed her to the floor of her home and sodomized her at 10 p.m.

Jean Sablon, the 'French Bing dies at age 87 Associated Press CANNES, France Jean Sablon, an elegant troubadour of French songs who in the United States was dubbed the "French Bing Crosby," has died at age 87. He died Thursday in a French Riviera hospital, which did not give a cause of death. Sablon had been reported ill for three years. Sablon was the first French singer to use a microphone, and made his name in France in music halls and cabarets. He went to the United States in 1937, where he Sablon adopted his St.

Sablon trademark pencil-thin mustache. He celebrated his 75th birthday with a 1981 performance at New York's Lincoln Center, and gave his farewell concert in 1983 in Rio de Janeiro. Among, his best-known songs: "J'attendrai" (I'll Wait), Le Printemps" (It's Spring), and "La Chanson des Rues" (Song of the Streets). Sablon, who never married, was known as a man of character. He refused to accept the prestigious Legion of Honor, saying his brother and sister earned the award for military contributions "and I'm not going to get it for pushing little songs." 4 grenades found along interstates in Cincinnati CINCINNATI (AP) Federal and city authorities are investigating the discovery of four grenades along Cincinnati highways.

A driver found a grenade yesterday along Interstate 74, with a detonator unit nearby. Thursday, three grenades were found on I-75, removed and detonated. All four grenades were rusted, and appeared to be of World War II vintage. They had been altered for use in practice throwing, but someone had packed them with a substance that may have been explosive, investigators said. "We're baffled with regard to where they're coming from," said Fire Chief Tom Steidel.
